State Fines
Current law allows the state of Missouri to impose and collect civil monetary penalties (fines) for instances of poor care in nursing homes. A number of states have statutory authority to impose
substantial fines against nursing home corporations as an extra tool in their arsenal of enforcement remedies for poor care. Unfortunately Missouri's law is far less aggressive.
Although a “state fine” law was in existence for many years in Missouri it was rarely used because of its cumbersome provisions. In August 2003, highly touted nursing home “reform” legislation became law in Missouri. This new law was supposed to enhance the imposition and collection of fines against deficient nursing homes. In reality the new statute has proven to be weaker than the previous law and has resulted in a lower collection rate for state fines.
Below is a listing of state civil monetary penalties (fines) collected from Missouri nursing homes since July 2003.
